A non-resident buyer has two due-diligence tracks running at once: the property and the capital flow. Colombia's Certificate of Tradition and Freedom (CTL) supports review of the registered legal position; foreign-investment and foreign-exchange rules determine how the investment and funds should be documented when applicable. Neither replaces case-specific legal, tax and technical advice.

Scope: this is general information, not legal, tax, foreign-exchange or immigration advice. The correct treatment can vary with residence, source of funds, acquisition vehicle, financing, intended use and transaction structure.

1. Start by identifying exactly what you are buying

The real-estate registration number (matrícula inmobiliaria) is central to Colombia's property registry review. Obtain a recent Certificado de Tradición y Libertad (CTL) through the official Superintendencia de Notariado y Registro portal and reconcile it with the deed/title, seller identity and physical description.

The CTL shows the registered legal history and status. Professional review should interpret ownership, mortgages, liens, limitations, attachments and other entries that may matter to the transaction.

2. Do not assume every advertised component is part of the same title

Confirm whether parking spaces, storage units or use rights have separate registrations; whether they are private assets or common areas with exclusive use; and whether the commercial offer matches the legal documents. Trust/fiduciary or development structures can require a different documentary review from a completed-property resale.

3. Review condominium rules before underwriting short-term rental income

If the investment case depends on tourist accommodation, operating viability should be tested before closing. Review the condominium rules, amendments, relevant assembly minutes, visitor policies, sanctions, access restrictions, contractor hours, pets and common-area rules.

For a short-term rental, an operating restriction can affect economics as materially as a large repair.

4. For a non-resident, the money trail is part of the acquisition file

Banco de la República includes Colombian real estate acquired by a non-resident among the assets that can constitute foreign direct investment. Its current guidance explains that where investment currency is channelled through the foreign-exchange market with the required minimum information, registration may occur automatically through the exchange declaration. Other transaction origins may follow different procedures.

Do not improvise this after the transfer. Before funds move, coordinate the payment route, exchange concept, beneficiary and support documents with the financial intermediary and qualified advisers. Traceability can matter for foreign-exchange rights and a future sale/repatriation.

5. Build an acquisition file, not a WhatsApp archive

6. Property tax and holding costs belong in the model before return

Medellín and Cartagena publish official property-tax channels and calendars. Do not model annual holding cost from a verbal number alone: verify the property-specific obligation and separate tax from condominium fees, insurance, utilities, maintenance and operating costs.

7. Technical inspection should look for future spend, not only current defects

In Cartagena, humidity, salinity and heavy air-conditioning use can change maintenance frequency. In Medellín, water ingress, waterproofing, ventilation, hills/access and building systems can alter operating cost. Review elevators, pumps, façades and pending condominium projects as well.

8. If the deal depends on Airbnb, stress-test both regulation and economics

Would you still buy if occupancy were 15 points below the base case? If the building approved a special assessment? If setup took three months? If achievable average daily rate were below the seller's example?

Due diligence should protect you from an investment thesis that works only in its best scenario.

A practical sequence before transferring funds

  1. Define the buyer and intended use.
  2. Obtain CTL and legal documents.
  3. Review condominium rules and liabilities.
  4. Complete technical inspection.
  5. Build a full economic model.
  6. Confirm the foreign-exchange and tax route with qualified advisers/intermediary.
  7. Document closing and handover conditions.
  8. After closing, retain one permanent file containing title, payment evidence, registrations and operating records.
A sound acquisition connects law, capital and operations.

Property Intelligence connects property due diligence with the reality of operating in Medellín or Cartagena.

Frequently asked questions

Can Colombian real estate acquired by a foreign buyer constitute foreign investment?

Banco de la República includes Colombian real estate acquired by a non-resident among assets that can constitute foreign direct investment. The applicable registration treatment depends on how the transaction and payment are structured.

Is the CTL enough to buy safely?

No. It is a central registry document, but it should be combined with legal review, condominium due diligence, taxes, technical condition, transaction documents and foreign-exchange analysis where applicable.

Do I have to register the investment before buying?

This guide cannot give a universal answer. Banco de la República distinguishes channelled and non-channelled transactions and different registration origins. Confirm the correct route before transferring funds.

Can I rely on the fact that other units in the building use Airbnb?

No. Existing short-term rentals do not replace review of the condominium rules, current requirements, unit-specific status and operating policies.

What should a technical inspection cover?

Water, moisture, electrical systems, HVAC, access, noise, windows/terraces, equipment and common systems that could create special assessments or operating downtime.
